ORDINANCE NO. 49

TOWN OF GRANT, WASHINGTON COUNTY, MINNESOTA

AN ORDINANCE ESTABLISHING FEES FOR APPLICATIONS FOR REZONING, SUBDIVISION, VARIANCE, SPECIAL USE PERMIT, CONDITIONAL USE PERMIT, STREET VACATION OR ANY OTHER APPLICATION FOR A PERMIT OR OTHER APPROVAL REQUIRED UNDER AND OFFICIAL CONTROL ESTABLISHED PURSUANT TO THE MUNICIPAL PLANNING ACT.

THE BOARD OF SUPERVISORS OF THE TOWN OF GRANT ORDAINS:

Section 1.  At the time of filing an application for rezoning, subdivision, variance, special use permit, conditional use permit, street vacation or any other application for a permit or other approval required under an official control established pursuant to the Municipal Planning Act, the applicant shall pay to the Town an amount of money sufficient to cover the Town's administrative and other costs incurred in the processing of the application.

Section 2.  The Town may require the applicant to deposit at the time the application is filed an amount of money sufficient to pay the costs of public notices, materials and staff consultant time and research for preparation of materials necessary to the processing of each application in addition to the application fee. At the time of filing of the application, the applicant shall pay to the Town the amount of fees established from time to time by Resolution of the Board of Supervisors.  Additional fees shall be paid whenever the Board of Supervisors or their designee determines that the actual cost will exceed those initially set by Board Resolution.  No action on the application shall be taken by the Town until all fees are paid as required.

Section 3.  No permit shall be issued until all costs and fees as provided herein have been paid.

Section 4.  The Board of Supervisors may waive any and all fees provided herein.

Section 5.  Every section, provision, or part of this Ordinance or any permit issued pursuant to this Ordinance is declared separable from every other section, provision or part thereof to the extent that if any section, provision or part of this Ordinance or any permit issued pursuant to this jurisdiction, it shall not invalidate any other section, provision, or part thereof.

Section 7.  This Ordinance shall be in full force and effect from and after its passage and publication according to law.
