AN ORDINANCE RELATING TO TRAFFIC REGULATION PROHIBITING UNREASONABLE ACCELERATION ON THE HIGHWAYS, STREETS AND ROADS WITHIN THE TOWN OF GRANT

The Board of Supervisors of the Town of Grant does ordain:

SECTION I.  Definitions.

1.1  Motor vehicle means every vehicle which is self-propelled and not deriving its power from overhead wires.

1.2  Unreasonable acceleration means to start or accelerate a motor vehicle in an unsafe, unreasonable or imprudent manner or in a manner that evidences an unnecessary exhibition of speed or creates unnecessary noise or nuisance.
 

SECTION 2.  Unreasonable Acceleration Prohibited.

Unreasonable acceleration of any motor vehicle on any street, highway, roadway, private road or driveway within the Town of Grant is hereby declared to be unlawful and a public nuisance.

SECTION 3.  Standard of Evidence.

It shall be prima facie evidence of unreasonable acceleration if a motor vehicle shall be observed starting or accelerating in such a manner as to cause squealing or screeching sounds emitted by the motor vehicle's tires, fishtailing of the motor vehicle, or the throwing of sand or gravel by the tires of said motor vehicle, or any combination of said actions.
 

SECTION 4.  Penalty.

Any person violating the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not to exceed $500 or imprisonment for a period not to exceed 90 days or both.
 

SECTION 5.  Effective Date.

This ordinance shall be in full force and effect from and after its passage and publication.
