ORDINANCE NO. 39

AN ORDINANCE REGULATING DOGS AND PRESCRIBING PENALTIES FOR THE VIOLATION THEREOF.
(Note: This ordinance was repealed by ordinance 1998-84.)

THE BOARD OF SUPERVISORS OF THE TOWN OF GRANT, WASHINGTON COUNTY, MINNESOTA, ORDAINS AS FOLLOWS:

Section 1.  Definitions.  As used in this Ordinance, the following terms shall mean:

A. Owner:  Any person, group of persons or corporation, firm or partnership, owning, keeping or harboring a dog or dogs.  The "harborer" of a dog shall mean any person who has custody of any dog or permits the same to be kept or to stay on or about his premises.

B. Police Officers or Police: The police officers of the Town of Grant and/or any firm, dog warden, agency or company hired by the Town of Grant to assist the police in the performance of their duties with regard to enforcement of this Ordinance.

C. Dog: Shall be intended to mean both male and female and shall include any animal of the dog kind.

Section 2.  Confinement. The owner shall confine within a building or secure enclosure any fierce, dangerous, or vicious dog, except when under restraint by a competent person.  Every female dog in heat shall be confined in a building, secure enclosure, veterinary hospital, or boarding kennel, or shall be controlled on a leash while being exercised.

Section 3. Public Nuisance.  Any dog is a public nuisance that has done any of the following:

(a) Has destroyed property or habitually trespasses in a damaging manner on property of persons other than the owner.

(b) Has attacked or bitten a person outside the owner's or custodian's premises.

(c) Has shown vicious habits or molested pedestrians or persons riding or driving on the public streets or highways.

Proceedings for abatement of Public Nuisance. After a finding by a court of proper jurisdiction that a dog is a public nuisance, as defined in Section 3, the court may order that the dog be destroyed or that the owner or custodian remove it from the township or keep it confined to a designated place.

Section 4.  Observation of dog after biting.  Any person knowing of a case of a human being bitten by a dog shall immediately notify the dog warden or police, who shall then order said dog impounded and quarantined for a period of fourteen (14) days, at the expense of the owner of the dog, before surrendering the dog to its owner.  If the owner has adequate facilities, the dog warden or police may allow the owner of the dog to impound it in said facilities.

Section 5.  Protection for dogs.  It shall be unlawful for anyone to place upon the ground or in any other manner any poison, bait or ground glass intended to harm a dog.

Section 6.  Penalties.  Any person who shall violate any of the terms and provisions of this Ordinance shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine of not more than $300.00 or by imprisonment for not to exceed ninety (90) days, or both.

Section 7.  validity.  The invalidity of any part of the Ordinance as declared by a Court of competent jurisdiction shall not affect the validity of the remainder thereof.

Section 8.  Effective date.  This ordinance shall take effect and be in force from and after its passage and publication.
