Ordinance No. 28

An Ordinance amending Ordinance No. 10 as amended by Ordinance No. 19 known as the zoning ordinance of the
Town of Grant.

The Board of Supervisors of the Town of Grant does hereby ordain, as follows:

Section 1.  Section 4 of Ordinance No. 10 as amended by Ordinance 19 of the Town of Grant is hereby amended by adding
the following as Section4.40:

Section 4.40. Raising of Non-domestic Animals.  No non-domestic animals as defined in Section 2.02 (E) shall be kept or
raised in an area of less than five (5) contiguous acres.  Such area shall be properly fenced so as to assure adequate
containment of such animal or animals and so as to further assure a minimum of 5 contiguous acres for the raising of said
non-domestic animals.

      a.                  In the event any portion of said 5 acres of contiguous land is rented or leased, any person proposing to raise a
non-domestic animal or animals on such land shall first file with the Grant Town Board, an executed copy of a
rental or lease agreement along with a drawing of the area proposed for such use.  The Grant Town Board
may impose such reasonable rules as it deems necessary in order to protect the health, safety, convenience,
and general welfare of the Town of Grant and in order to assure that such use will not seriously depreciate
surrounding property values and that such use is in harmony with the general purpose and intent of the Zoning
Ordinance of the Town of Grant.

Section 2.  Any person, firm, partnership or corporation who shall violate any portion of this ordinance shall be guilty of a
misdemeanor and upon conviction thereof be fined a sum not to exceed Three Hundred Dollars ($300.00) or imprisonment for
a period not to exceed ninety (90) days or both.

Section 3.  This ordinance shall be in full force and effect from and after its adoption and publication according to law.

Adopted this 17 day of March, 1970.
