Ordinance Number 2003-98

An Ordinance repealing Ordinances 8, 20, 62 and 96 enacting an Ordinance Establishing a Planning Commission for the City of Grant, Washington County, Minnesota.

The City Council of the City of GrantWashington CountyMinnesota, does hereby ordain:

Section 1.Establishment of a City Planning Commission. A City Planning Commission for the City of Grant is hereby established pursuant to Minnesota Statutes 462.351 to 462.364 inclusive.

Section 2.Composition. The Planning Commission shall consist of 7 to 11 members, and the members shall be appointed by the City Council by a four fifths vote of the City Council.The members of the Planning Commission first appointed shall be as follows: one-third for a term of one year; one-third for a term of two years; and one-third for a term of three years. Their successors shall be appointed for terms of three years.The terms of the office shall begin at the first regular City Council meeting in March of each year.Both original and successive appointees shall hold office until their successors are appointed and have qualified.


The members of the Planning Commission shall annually elect one member as Chair and one member as Vice-chair.


The City Council shall appoint one of the members of the City Council to serve as an ex-officio member of the City Planning Commission, who shall not have a vote in any proceedings before said Planning Commission or hold any office.


A quorum shall be at least 5 members present, prior to any business being conducted at the meetings.


The meeting shall be conducted according to Robert's Rules of Order.

Section 3.Qualifications.
Every member of the Planning Commission shall be a registered voter in the City of Grant.


Every member shall, before entering upon the disposition of his duties, take an oath that he or she will faithfully perform the duties of his or her office.


All members shall serve without compensation, and may be removed by a four fifths vote of said City Council.


Any member who fails to attend five regular meetings of the Planning Commission during any consecutive twelve-month period shall be automatically dismissed from the Planning Commission.The City Council may review each such case and reappoint said member if it so chooses. Attendance records before the passage of this Ordinance shall not be considered for dismissal.

No member of the Planning Commission may participate in discussion on or vote on any issue or proceeding in which the member has a conflict of interest.Members having a conflict of interest on a specific zoning review or application are expected to recuse themselves and step down during Planning Commission discussion and action.

Expenditures of the Planning Commission shall be within amounts appropriated for that purpose by the City Council.

Section 4.Duties.
 

The Planning Commission shall have the duty to review, study and make recommendations to the City Council on the following:

(1)Comprehensive Plan for the land use of said City;

(2)Applications for rezoning, conditional use permits, variances, subdivisions and related matters;

(3)Conducting such public hearings, as they are required to do by law and/or at the request of the City Council;

(4)Initiate and review ordinances for consideration by the City Council;

(5)Such other duties as the Grant City Council may delegate.

Such recommendations shall then be acted upon in accordance with Minnesota Statutes 15.99, if applicable, and all other laws of the State of Minnesota and in no event shall any recommendation not be acted upon within 50 days by the City Council.

Section 5.Vacancies


Planning Commissioners whose terms are expiring will be reappointed if they are willing to continue to serve unless by a four fifths vote the City Council votes not to re-appoint the Planning Commission member.

Vacancies during a term shall be filled by the City Council for the un-expired term of said vacancy by a four fifths vote of the City Council after utilizing the following process:


The City Clerk shall publish in the official newspaper of the City a notice that a vacancy on the Planning Commission exists and that any interested person may make an application for appointment to the City Council.


Applicants for appointment shall apply in writing using the appropriate forms as may be required and the City Council shall interview those candidates that it deems appropriate before appointment to the Planning Commission by the City Council.


Vacancies due to the expiration of a term and when the City Council determines not to reappoint the planning commission member as follows:


The City Clerk shall publish in the official newspaper of the City the notice of vacancy and requesting that interested individuals fill out an application on the appropriate forms.

The City Council shall then interview those candidates that it deems appropriate before making an appointment to fill the vacancy on the Planning Commission.


The appointment process shall be handled by the City Council at a regular or special meeting in March of each year in order to allow an opportunity for candidates to file applications and to interview applicants.

Section 6.Meetings. The Commission shall hold at least one regular meeting each month, unless there are no applications to review. It shall adopt rules for the transaction of business and shall keep a record of its resolutions, transactions, and findings, which shall be a public record.
At each regular monthly meeting of the City Council, the Commission shall submit to the City Council a report of its work during the preceding month.

Section 7.Repealing Previous Ordinances. This ordinance hereby repeals Ordinance Number 8, 20 62, and 96 of The City of Grant.

Section 8.Effective Date. This ordinance shall be in full force after its passage and publication according to law.
