ORDINANCE 2000-93

AN ORDINANCE REGULATING THE USE OF FIREARMS AND WEAPONS IN THE CITY OF GRANT, WASHINGTON COUNTY, MINNESOTA.
  The City Council of the City of Grant, Washington County, Minnesota, does hereby ordain as follows:
Sec. 93.02. Definitions.  As used in this ordinance, the following definitions shall apply:
 1. Firearm means a gun that discharges shot, bullet or other projectile by means of an explosive, a gas, compressed air, or other propellant.
 2. Shotgun means a shoulder firearm from which shot or a legal shotgun slug is discharged by means of a solid propellant; muzzle-loading rifles of legal caliber are included in this category.
 3. Air gun means any rifle, pistol or revolver by which a projectile is discharged by means of compressed gas, but does not include the so-called BB guns.
 4. Public places include all property owned by the State of Minnesota, the County of Washington, the City of Grant, or other political subdivision of the State of Minnesota; public roadways and streets within the Township; cemeteries; and places of public accommodation.
  5. Ranges.  See Zoning Ordinance 50 Section 720.012 Definitions.
 6. Weapon means any device designed for or capable of being used for the sport of target shooting or hunting in all of its various forms, such as, but not limited to firearms and archery equipment.
Sec. 93.04. Illegal Use of Firearms.
  1. Except as hereinafter provided, no person shall discharge upon, over, or onto the land of another a firearm of any kind; bow and arrow, crossbow, or any air gun, BB gun, sling shot, or other devices for the propulsion of shots or metal pellets by means of compressed air, gas or mechanical spring action, within the limits of the City of Grant, without the express written and dated permission of the owner or lessee of such property to discharge such firearms, weapon or other device thereon.
  2.  Except at target ranges as defined in Ordinance 50 Section 720, no person shall discharge at any time whatsoever, a rifle, pistol or revolver of a caliber greater than a .22 long rifle. This section does not prohibit the use of a shotgun.
 Sec. 93.06. Unlawful Discharge of Firearms, Air Guns or Bow and Arrows.
  1. It shall be unlawful for any person, within one-half (1/2) mile, to discharge any rifle, pistol or revolver in the direction of any building, excepting the owner or lessee of said building.
  2. Shot guns, bows and arrows, crossbows, air guns, sling shots or any other similar device for the propulsion of shots or metal pellets by means of compressed air, gas or mechanical spring action, may not be discharged, within Five Hundred (500) feet, in the direction of any building except by the owner or lessee of said building.
  3. It shall be unlawful for any person to discharge any firearm, air gun or other weapon in any public place whatsoever in the City of Grant.
Sec. 93.08. Penalties.
  Violations of this ordinance are a misdemeanor and are punishable by the current maximum allowed by state law.  In addition the cost of prosecution may be added.
Sec. 93.10. Repeal.
  Ordinance No. 17, Ordinance No. 47, Ordinance 57, Ordinance 87 and all other ordinances that may be in conflict herewith are hereby repealed.
Sec. 93.12. Severability.

  In the event that a court of competent jurisdiction adjudges any part of this Ordinance to be invalid, such judgment shall not affect any other provision of this Ordinance no specifically included within that judgment.
Sec. 93.14. Effective Date.
  This Ordinance shall be in full force and effect from and after its passage and publication according to law.
