ORDINANCE NO. 96-74
 
 

AN ORDINANCE ESTABLISHING A STORM SEWER IMPROVEMENT TAX
DISTRICT WITHIN THE MEANING OF MINNESOTA STATUTE §444.16 ET. SEQ.

The Town Board of Supervisors of the Town of Grant, Washington County, Minnesota hereby ordain as follows:

Section 1.  Purpose.

This  Ordinance  is  adopted  to  establish  a  storm  sewer improvement tax district within the meaning of Minnesota Statute ~444.l6 et. seq.  The District is established in order to authorize and fund a study and any necessary improvements to solve a problem with flooding existing in the Town of Grant.  This flooding has caused property damage to citizens and has endangered and made impassible certain public roads.

The Town has determined that it is in the best interests of the Town to set up a method to insure that work is done to the benefit of the residents of the area and that the costs are fairly and equitably apportioned among those properties contributing water to the flooding problem.

Section 2.  Authority.

The Town has adopted this Ordinance pursuant to the provisions of Minnesota Statute ~444.16 et. seq.

Section 3.  Description of Land.

Pursuant to Minnesota Statute §444.17, the territory or area included within the storm sewer improvement district is described with particularity on the attached Exhibit A,  said land is hereinafter referred to herein as the "Subwatershed."

Section 4.  Name of District.

The storm sewer improvement district created herein shall hereinafter be referred to as the "Town of Grant Storm Sewer Improvement Tax District No. 1."

Section 5.  Ordering the Study.

The Washington County Soil and Water Conservation District (or its  federal or state counterpart agencies)  have commenced a comprehensive storm sewer improvement study to determine what storm sewer improvement project, if any, should be undertaken to solve the problem with the flooding referred to herein.   The report advises the Town in a preliminary way as to:

a. whether the proposed improvement is feasible;
b. whether it should be made as proposed or in connection with some other improvements;
c. the estimated cost of the improvement; and,
d. a proposed method for assessing the costs of the study and any proposed improvement projects upon the lands within the Subwatershed.

The Town shall discuss said report and determine whether or not plans and specifications should be prepared, and what other steps, if any, should be taken by the Town.  At said meeting, the Town shall also discuss such other issues, and take such other actions, as are relevant to a proper determination of the cause.
 

Section 6.  Filings.

The Town Clerk is hereby directed to file a certified copy of this Ordinance with the County Auditor and a separate copy with the County Recorder pursuant  to  the  statutory mandate  found in Minnesota Statute §444.17.

Section 7.  Effective Date.

This Ordinance shall be in full force and effect from and after its passage of publication according to law.

Whereupon this Ordinance was declared passed and adopted by the Town Board of Supervisors of the Town of Grant, Washington
County, Minnesota, this 20th day of August, 1996.
