AN ORDINANCE AMENDING TOWNSHIP SUBDIVISION ORDINANCE
SECTION 906.01
 

The Board of Supervisors of the Town of Grant, Washington County, Minnesota, does hereby ordain as follows:

A. That Township Subdivision Ordinance No. 906.01 is hereby AMENDED as follows:

(1) Section 906.01 is amended by deleting the existing paragraph in its entirety and replacing it with the following:
 906.01. Resubdivision/Rearrangement. Land which is
located within a recorded plat shall not be resubdivided and/or rearranged into smaller parcels except as stated herein.

A. Land which is located within a recorded plat may be resubdivided   and/or   rearranged   unless   said resubdivision or rearrangement would result in an increase in the density of the plat as a whole.

B. Notwithstanding Subdivision A above, land within a recorded plat may be resubdivided or rearranged if, at the time of the recording of the original plat, the plat, development agreement, or other written and  recorded  document,  signed  by  the  Town, specifically reserved the right  to resubdivide and/or rearrange land within that plat.

C. All  applications  for  the  resubdivision  and/or rearrangement of a recorded plat must follow all town ordinances for the resubdivision of land.  The proper  procedure  to  follow  pursuant  to  town ordinances shall be based upon the total number of new lots proposed to be created and/or rearranged pursuant  to said application for resubdivision and/or rearrangement.

B.Effective Date.  This Ordinance shall be in full force and effect from and after its passage and publication according to law.
 

Passed and adopted by the Town Board of Supervisors of the Town of Grant, Washington County, Minnesota on the 6th day of August, 1996.
