ORDINANCE NO. 13
    An ordinance providing for the issuance of contractors permits and for the bonding of individuals, firms, corporations, contractors and sub-contractors doing or performing work within the town of Grant and for which permits are required as set forth in the applicable codes and ordinances of said town and providing penalties for violations.
    The town board of supervisors of the town of Grant, Washington County, Minnesota, does ordain:
        Section 1:    That it is deemed in the interest of the public and the residents of the Town of Grant that  the work involved in building, alteration and construction and the installation of various appliances and service facilities in and for said buildings be done only by individuals, firms and corporations that have demonstrated or submitted evidence of their competency to perform such work in accordance with the applicable codes and ordinances of the Town of Grant regulating same.

        Section 2:    The permits which the Town Clerk is authorized to issue under the applicable codes and ordinances of the Town of Grant shall be issued only to individuals, firms, or corporations holding a contractor's permit issued by the Town for work to be performed under the permit, except as hereinafter noted.

        Section 3:    Application for contractor's permit shall be made to the Town Board and such contractor's permit shall be granted by a majority vote of the Town Board of Supervisors upon proof of the applicant's qualifications therefore and upon filing a bond in the amount of $2,500.00, conditioned upon the faithful and lawful performance of all work entered upon by him within the Town of Grant and in accordance with the applicable codes and ordinances of the said Town and such bond shall be for the benefit of persons injured or suffering financial loss by reason of failure of such performance provided, however, that no individual, partnership, corporation or other business association holding a plumbing or electrical license from the State of Minnesota and bonded to said State shall be required to file a bond as provided herein.  Application for said contractor's permit above described shall further be conditioned upon the filing of certificates evidencing the holding of Public Liability Insurance in the limits of $   50,000.00 per person, $100,000.00 per accident for bodily injuring and $10,000.00 for property damage and certificates of workmen's Compensation Insurance as required by law.

        Section 4:    The annual fee for each contractor's permit shall be $25.00, which contractor's permit shall expire on the twelfth month following the date of it's issuance.

        Section 5:    Contractor's permits shall be obtained by every person engaging in the following businesses or work in accordance with the applicable ordinances of the Town of Grant:
 
                            (a)    General Contractors in the business of building construction.
                            (b)    Masonry and brick work.
                            (c)    Plumbing including the installation of cesspool, septic tank, drain fields
                                    connections to Municipal system and inside plumbing.
                            (d)    Roofing
                            (e)    Plastering stucco work, sheet rock taping.
                            (f)    Heating, ventilation and refrigeration.
                            (g)    Gas Piping, Gas Services, Gas Equipment Installation.
                            (h)    Oil Heating and Piping work.
                            (i)    Water supply system installation, construction and connection.
                            (j)    Sanitary sewer and water line installation
                            (k)    Excavations including excavation for footing, basements, sewer and water line
                                    installation.
                            (l)    Moving and wrecking of building.
                            (m)    Sign erection, construction, and repair including billboards, and electrical signs.

Nothing herein shall be construed as preventing any such qualified permute from performing the work by an employee under his supervision and control, and provided further that nothing herein shall be construed as requiring an individual to obtain a contractor's permit for any work performed on his own property.

        Section 6:    No individual, partnership, corporation or other business association holding a plumbing or electrical license from the State of Minnesota shall be required to pay a license or registration fee herein provided, however, that each individual, partnership, corporation or other business association doing electrical or plumbing work within the Town of Grant shall have on file with said Town a copy of current license issued by the State of Minnesota or such other evidence of such license as may be provided by the State of Minnesota.

        Section 7:    Public service corporations shall not be required to obtain contractor's permits for work upon or in connection with their own property except as may be provided by other ordinances.

        Section 8:    Manufacturers shall not be required to obtain contractor's permit for work incorporated within equipment as a part of manufacturing except as may be provided by other ordinances.

        Section 9:    A person, firm or corporation who shall violate any of the provisions of this ordinance shall be guilty of a misdemeanor and upon conviction thereof, shall be punished by a fine or not more than one hundred dollars ($100.00) for each offense or by imprisonment for not more than ninety (90) days.

        Section 10:    This ordinance shall not be construed to affect the responsibility or liability for any party owning, operating or installing the above described work for damages to persons or property caused by any defect therein or shall the Town of Grant be held as assuming any such liability by reason of the licensing of persons, firms, corporations engaged in such work.

        Section 11:    If any section, sub-section, sentence, clause, or phrase of this ordinance is for any reason held to be unconstitutional such decision shall not affect the validity of the remaining portions of this ordinance.  The Town Board of Supervisors of the Town of Grant hereby declares that it would have passed this ordinance, any section, sub-section, sentence, clause, or phrase thereof, irrespective of the fact that any one or more sections, sub-sections, sentences, clauses, or phrases be declared unconstitutional.

        Section 12:    This ordinance shall take effect after its passage and publication according to the law.

            Adopted this 14th day of May, 1968 by the Town Board of Supervisors of the Town of Grant.
